1. Scope
This Shipping Policy applies to all orders placed through the MAMAS KAFFEE online shop at https://mamaskaffee.com.
Our General Terms and Conditions and Instructions on Withdrawal also apply.
2. Delivery areas
We deliver within Germany and to the countries of the European Union that can be selected during checkout.
Delivery to an address that cannot be selected during checkout is possible only by prior individual agreement.
3. Shipping providers
Depending on the type, weight, dimensions and delivery destination of the ordered goods, shipping is carried out, in particular, by:

DHL;
-
DPD;
-
a forwarding agent or carrier selected by us.
We select the shipping provider unless the customer is expressly offered a choice during checkout.
The customer is entitled to delivery by a particular shipping provider only where this has been expressly agreed.
4. Processing time
Orders are generally processed within 1 to 3 working days after conclusion of the contract or receipt of full payment.
For advance payments, the processing period begins on the first working day after receipt of the full invoice amount.
Working days are Monday to Friday, excluding public holidays at our registered place of business.
Orders are generally not processed or dispatched on Saturdays, Sundays or public holidays.
5. Delivery times for coffee and goods suitable for parcel delivery
For coffee, coffee beans, ground coffee, capsules, pads and other goods suitable for parcel delivery, transport generally takes 3 to 5 working days after the goods have been handed over to the shipping provider.
Taking the processing period into account, the total delivery time within Germany is generally 4 to 8 working days after conclusion of the contract or, in the case of advance payment, after receipt of payment.
If a different delivery time is stated on the product page or during checkout, the delivery time stated there shall prevail.
6. Delivery times for coffee machines, coffee grinders and equipment
The delivery time for coffee machines, coffee grinders, display cabinets, ice cream machines and other equipment depends on availability, dimensions, weight, delivery method and delivery destination.
Transport after the goods have been handed over to the shipping provider or forwarding agent generally takes 7 to 30 working days.
Taking the processing period into account, the total delivery time may generally be 8 to 33 working days.
If a specific or different delivery time is stated on the product page, in the offer, in the order confirmation or during checkout, that delivery time shall prevail.
If no delivery time is specified for a consumer order, delivery will take place no later than 30 days after conclusion of the contract unless a different delivery time has been expressly agreed.
7. Calculation of the delivery period
For payment methods other than advance payment, the delivery period generally begins upon conclusion of the contract.
For advance payments, the delivery period begins on the first working day after receipt of full payment.
If the final day of the delivery period falls on a Saturday, Sunday or public holiday at the delivery destination, the period ends on the next working day.
For an order containing several products with different delivery times, the longest stated delivery time generally applies unless a partial delivery is made.
8. Delivery delays and temporary delivery obstacles
In the event of temporary delivery obstacles for which we are not responsible despite exercising reasonable care, the delivery period may be extended by a reasonable period.
Such circumstances may include, in particular:

natural events;
-
official measures;
-
lawful industrial disputes;
-
war or civil unrest;
-
epidemics;
-
significant and unforeseeable transport disruptions;
-
unforeseeable failures of essential supply chains.
We will inform the customer without unnecessary delay of any significant delivery delay.
The customer’s statutory rights in the event of delayed delivery remain unaffected.
9. Shipping costs within Germany
The following conditions apply to delivery addresses within Germany:
-
For an order value below €60.00, the shipping costs displayed during checkout will be charged.
-
For an order value of €60.00 or more, delivery within Germany is free of charge.
The order value relevant for free delivery is the amount actually payable for the goods after deduction of discounts, vouchers and other price reductions.
Free delivery from an order value of €60.00 also applies to large or heavy goods delivered by a forwarding agent.
Additional services expressly requested by the customer, including:
-
delivery into a building;
-
delivery to a particular floor;
-
carrying goods inside the building;
-
assembly;
-
installation;
-
connection;
-
commissioning;
-
instruction;
-
disposal of packaging or old equipment,
are not included in the free standard delivery and may be provided only by separate agreement and for an additional charge.
10. Shipping costs within the European Union
For deliveries to other countries of the European Union, shipping costs are calculated according to the destination country, weight, dimensions, type of goods and shipping provider.
The specific shipping costs are displayed during checkout before the binding order is submitted.
Free delivery from an order value of €60.00 applies exclusively to delivery addresses within Germany and does not apply to deliveries to other countries.
Shipping surcharges or other delivery costs charged by us will not be subsequently charged to consumers without their consent if they were not displayed before the order was submitted.
11. Freight delivery of large and heavy goods
Large or heavy goods are delivered by a forwarding agent selected by us.
Unless expressly agreed otherwise, delivery is made:
Free kerbside delivery
This means that the goods are delivered to the nearest unloading point at the specified delivery address that can be reached by the delivery vehicle.
Standard delivery does not include:
-
carrying or moving the goods into a building;
-
transporting the goods over stairs;
-
transporting the goods to a particular floor;
-
using a lift;
-
placing the goods at their final intended location;
-
assembly;
-
installation;
-
connection to electricity, water or drainage;
-
commissioning;
-
instruction;
-
disposal of transport packaging.
The customer is responsible for onward transport from the unloading point.
12. Requirements for freight delivery
The customer must ensure that:
-
the delivery address can be reached by a vehicle suitable for the goods;
-
the access route and unloading point are sufficiently accessible;
-
an authorised recipient is present at the agreed time;
-
any necessary permits or access authorisations are available;
-
the goods can be safely accepted at the unloading point.
If the delivery address cannot be reached because of narrow roads, weight restrictions, construction work, insufficient access or other local conditions, the goods will be handed over at the nearest reasonable and accessible point.
The forwarding agent may contact the customer using the telephone number or email address provided with the order to arrange a delivery date.
13. Partial deliveries
We may deliver an order in separate shipments where this is reasonable for the customer.
Consumers will not incur additional shipping costs as a result of a partial delivery arranged by us.
14. Shipping confirmation and shipment tracking
After dispatch, the customer will generally receive a shipping confirmation by email.
Where shipment tracking is available, the confirmation will contain a tracking number or a link to the tracking service.
It may take up to 24 hours for the tracking number to be activated by the shipping provider and for the first status to appear.
Tracking may operate differently for freight deliveries. The forwarding agent may arrange the delivery date directly with the customer.
15. Undeliverable shipments and incorrect address information
The customer must provide a complete and correct delivery address when placing the order.
If a shipment cannot be delivered because of an incorrect or incomplete address for which the customer is responsible, an unjustified refusal to accept delivery or another breach of duty for which the customer is responsible, we may charge the reasonable costs actually incurred for returning and resending the goods.
The customer may provide evidence that no loss was incurred or that the loss was significantly lower.
If the customer is not responsible for the failed delivery, no additional costs will be charged.
The consumer’s statutory right of withdrawal remains unaffected. Merely refusing to accept a shipment does not replace a clear notice of withdrawal.
16. Default of acceptance for freight deliveries
If an agreed freight delivery cannot be completed for reasons for which the customer is responsible, reasonable additional costs actually incurred may be charged. These may include, in particular, costs for:
-
an unsuccessful delivery attempt;
-
redelivery;
-
necessary temporary storage;
-
return transport.
The customer may provide evidence that no loss was incurred or that the loss was significantly lower.
Further statutory rights remain unaffected.
17. Transfer of risk
For consumers within the meaning of Section 13 of the German Civil Code (BGB), the risk of accidental loss or accidental deterioration of the goods generally passes only when the goods are handed over to the consumer or to a recipient authorised by the consumer.
This does not apply where the consumer independently appoints a shipping provider that we had not previously named.
For businesses within the meaning of Section 14 BGB, the risk passes when the goods are handed over to the forwarding agent, carrier or other shipping provider.
Our liability for inadequate packaging, incorrect handover, defective shipping preparation or another breach of duty for which we are responsible remains unaffected.
18. Transport damage
We ask consumers to inspect the delivery for visible transport damage after receipt and, where possible, to notify us of such damage within 48 hours.
Compliance with this period is not a prerequisite for statutory claims. Consumers’ statutory warranty rights and rights relating to defects remain fully unaffected.
In the event of visible transport damage, we ask the customer, where possible, to:
-
have the damage documented by the delivery provider or forwarding agent;
-
take photographs of the outer packaging, inner packaging and damaged goods;
-
retain the packaging and damaged goods until the matter has been resolved;
-
provide us with the order number, a description of the damage and any available evidence.
Business customers must comply with any applicable statutory duties to inspect the goods and give notice of defects, in particular under Section 377 of the German Commercial Code (HGB).
19. Customs duties, taxes and import charges
Deliveries within the European Union are generally not subject to additional import customs duties.
Deliveries to special territories or individually agreed deliveries outside the European Union may be subject to customs duties, import taxes, fees or other charges.
Such charges are not levied by us and, unless expressly agreed otherwise, must be paid by the customer directly to the competent authorities or service providers.
For consumers, all shipping costs charged by us that can be determined in advance will be displayed before the order is submitted.
20. Retention of title
The delivered goods remain our property until the purchase price has been paid in full.
For business customers, the provisions on retention of title contained in our General Terms and Conditions also apply.
21. Returns and withdrawal
Our separate Instructions on Withdrawal and Return and Refund Policy apply to withdrawals, returns and reimbursements:

Free delivery of the original order does not mean that we will bear the cost of returning the goods.
In the event of a statutory withdrawal, the consumer bears the direct cost of returning the goods, provided the consumer was properly informed of this before the contract was concluded and we did not expressly agree otherwise.
The statutory provisions apply to defective, damaged or incorrectly delivered goods.
