Instructions on Withdrawal and Return and Refund Policy

1. Right of withdrawal for consumers

Consumers have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day:

  • on which you, or a third party designated by you who is not the carrier, took possession of the goods;

  • in the case of a single order containing several goods delivered separately, on which you, or a third party designated by you who is not the carrier, took possession of the last item;

  • in the case of goods delivered in several partial shipments or pieces, on which you, or a third party designated by you who is not the carrier, took possession of the final partial shipment or the final piece.

To exercise your right of withdrawal, you must inform us:

of your decision to withdraw from this contract by means of a clear statement, for example by a letter sent by post or by email.

You may use the model withdrawal form provided at the end of these instructions, but using the form is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning the exercise of the right of withdrawal before the withdrawal period expires.

2. Consequences of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the cost of the least expensive standard delivery method offered by us.

Additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us will not be reimbursed.

The reimbursement will be made without undue delay and no later than fourteen days from the day on which we receive your notification of withdrawal from this contract.

We will make the reimbursement using the same payment method that you used for the original transaction, unless expressly agreed otherwise with you. You will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

3. Returning the goods

You must return or hand over the goods without undue delay and no later than fourteen days from the day on which you inform us of your withdrawal from this contract, to:

The deadline is met if you send the goods before the fourteen-day period expires.

You are responsible for the direct cost of returning the goods.

Please return the goods with sufficient postage and, where possible, with shipment tracking. Please avoid sending parcels with postage due. However, this does not restrict your exercise of the statutory right of withdrawal.

4. Examination of the goods and compensation for loss of value

You may examine the goods to the extent necessary to establish their nature, characteristics and proper functioning.

You are only liable for any loss of value resulting from handling the goods in a manner beyond what is necessary to establish their nature, characteristics and proper functioning.

Use of the original packaging is not mandatory for the valid exercise of the right of withdrawal. However, where possible, we ask you to return the goods complete, securely packaged and with all supplied accessories to prevent damage during transport.

5. Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply, in particular, to contracts for the supply of:

  • goods that are not prefabricated and whose production is determined by an individual choice or decision by the consumer, or goods that are clearly personalised to the consumer’s needs;

  • goods that are liable to deteriorate rapidly or whose expiry date would soon be exceeded;

  • sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

Whether a statutory exception applies is determined by the characteristics of the specific product. Opening product or food packaging does not automatically result in the loss of the right of withdrawal for every product.

The consumer’s statutory rights regarding defective or incorrectly delivered goods remain unaffected.

6. Cancellation before dispatch

As long as an order has not yet been fulfilled or dispatched, it may be cancelled using the cancellation function provided in the online shop.

If automatic cancellation is no longer available, please contact us immediately at info@mamaskaffee.com.

This voluntary cancellation option does not restrict the consumer’s statutory right of withdrawal.

7. Transport damage and defective goods

Please inspect the delivery as soon as reasonably possible after receipt.

If the goods are damaged, defective or incorrectly delivered, please contact us at info@mamaskaffee.com and, where possible, provide your order number.

Our voluntary request for the prompt reporting of transport damage does not constitute an exclusion period. Your statutory warranty rights remain fully unaffected.

8. Returns outside the statutory withdrawal period

Returns after the statutory withdrawal period has expired are only possible by prior agreement. There is no entitlement to voluntary acceptance of a return.

Statutory rights concerning defective or incorrectly delivered goods remain unaffected.

9. Orders placed by businesses – B2B

The statutory right of withdrawal applies exclusively to consumers within the meaning of Section 13 of the German Civil Code (BGB).

Businesses within the meaning of Section 14 BGB do not have a statutory right of withdrawal. Returns of B2B orders are only possible with our prior express approval.

Statutory rights relating to defects and warranties, as well as any applicable duties to inspect goods and report defects, remain unaffected.
